SB185 has been signed by Gary Herbert after the House passed it 50-8.
Rep. Keven Stratton, R-Orem, the House sponsor of the bill, said, "This is an effort to hold those who are profiting from the harm [of pornography] accountable for the damages that are done."
SB185 amends the Judicial Code to provide for a cause of action for minors injured by pornography. Excluded are internet service providers, online search engines, and satellite television providers. The bill protects pornographers from liability if they include a warning with the content that pornography can be dangerous and also make a good faith effort to verify that minors aren’t viewing pornographic content.
The bill is a sequel to a resolution last year that declared pornography to be a "public health crisis."
